For licensed agents in Arizona and Colorado
Can an agent post a for sale by owner home on Facebook Marketplace?
With the owner's written permission, yes. In Colorado the rule lists four conditions, and the main one is saying plainly that the owner is not represented by a broker.
A home for sale by owner has no listing brokerage, so the usual courtesy line has nobody to name. That does not make it free to post. The owner decides who advertises their home, and an agent who posts it carries the same advertising duties as for any other home.
What Colorado requires
Colorado rule 6.10.F.2 covers a broker disseminating the advertising of an owner who is not represented by a brokerage firm. It sets four conditions:
- You have the owner's written permission to disseminate the advertising.
- You disclose, in a conspicuous manner, that the owner is not represented by a broker.
- The advertising is accurate and not misleading to consumers.
- It does not include submitting the information into a property exchange or listing service.
Rule 6.10.G adds that the price quoted in advertising must be the price agreed between the broker and the owner, and rule 6.10.C makes you responsible for accuracy and for copyright. So use the owner's photos only with their say so, and quote the price the owner gave you.
What Arizona asks
Arizona rule R4-28-502 asks for the property owner's written consent before advertising a specific property, in subsection I, and your employing broker's name must be identified clearly and prominently, in subsection E. Subsection J adds that online, every advertising requirement must be met on the advertisement without the need to scroll. Ask your designated broker how they want it handled.
What it does not mean
- You are not the owner's agent. No listing agreement exists, so do not describe yourself as representing the sale.
- The owner's agreement to let you advertise is not a commission agreement.
- A buyer who writes to you is a conversation. Working with that buyer follows the same written agreement and disclosure steps as any other buyer.
A short permission note
Hi, I am a licensed agent with Example Realty. May I post your home at the address you gave me on Facebook Marketplace, using your photos, with the price you set? The post would say you are selling it yourself and are not represented by a broker. Please reply in writing with the dates you are fine with.
Keep the reply with the date, the same way you would keep a written yes from a managing broker.
Where the software fits
Listing AutomatEr is a desktop app for Mac and Windows built to post listings you have permission to market, with the agent line, the brokerage credit and a marketing on behalf line written on each post. It does not obtain permission and it does not judge whether a post meets your state's rules. For a home with no listing brokerage, the rule above is yours to follow.
Common questions
Do I need the owner's permission to post their for sale by owner home?
Yes. Colorado rule 6.10.F.2 requires the owner's written permission, and Arizona asks for the owner's written consent before advertising a specific property.
What must the post say about a for sale by owner home in Colorado?
A conspicuous disclosure that the owner is not represented by a broker, plus accurate information and your brokerage firm's name on the advertising.
Can I quote a price for the home?
Quote the price the owner agreed with you. Colorado rule 6.10.G says the price in advertising must be the price agreed between the broker and the owner.
Does this make me the owner's agent?
No. Posting with permission is not a listing agreement, so do not describe yourself as representing the sale.
